The legal repercussions for the driver, Brendan Ross, a member of Sigma Phi Epsilon fraternity, are still uncertain, as Ross passed a sobriety test shortly after the crash, according to the News. Ross and his defense attorney claim that the crash occurred due to a vehicle malfunction. The U-Haul vehicle is being held by the police until tests determine the validity of this claim. If a vehicle malfunction can be proved, Ross' legal culpability may be lessened and the U-Haul company may be liable, the News reported.
